Open bottle law-possession — Brayan A. Espinoza, 18, of Laredo, Texas; fined $185.
Driving without a valid license for vehicle class or type — Scott M. Nivarel, 41, of Rice Lake, Wis.; fined $185.
Matthew L. Bauman, 27, of Fairmont received an amended court decision on a charge of domestic assault-intentionally attempts to inflict bodily harm on another; complete and update a chemical dependency assessment and follow all recommendations.
Brittany L. Fuller, 35, of Sioux Falls, S.D. had a charge of issue dishonored check-offense continued for dismissal; fined $134.12, restitution $134.12, six months unsupervised monitoring without conviction, pay restitution, no same or similar.
Claire N. Gerhardt, 23, of Fairmont was convicted driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, no same or similar. Additional charges of fourth-degree driving while impaired, and operate motor vehicle while under the influence of alcohol, were both dismissed.
Todd A. Kleine, 56, of Fairmont was convicted on a felony charge of domestic assault by strangulation; fined $1,185, commit to Commissioner of Corrections 21 months, stayed three years, sentenced to jail 60 days, credit for time served 35 days, three years supervised probation, contact probation officer as directed, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, complete domestic abuse batterer’s intervention program and pay the cost, no direct or indirect contact with the victim(s), Domestic No Contact (DANCO) for three years, pay restitution if filed within 60 days, complete chemical assessment, follow recommendations of evaluation, don’t drive without a valid license, complete a psychological evaluation if recommended by probation, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. An additional felony charge of terroristic threats-reckless disregard risk, and a misdemeanor charge of domestic assault-subsequent violation, were both dismissed.
Nick Yarrito, 47, of Madelia was convicted of give peace officer false name/birthdate/ID card; fined $285, sentenced to jail 60 days, credit for time served 60 days. Also convicted of failure of driver to carry proof of insurance when operating a vehicle; fined $285, sentenced to jail 60 days, credit for time served 60 days. Additional charges of driving after revocation, theft-take/use/transfer movable property without consent, and vehicle registration-unregistered-certain acts forbidden, were all dismissed.
Joel W. Pigeon, 41, of Roseville, Mich. had a charge of speeding continued for dismissal; fined $200, six months unsupervised monitoring without conviction, no same or similar.
Juvencio L. Saldana, 60, of Elmore was convicted of speeding; fined $135. Additional charge of failure of driver to carry proof of insurance when operating a vehicle was dismissed.
